It has
recently come to my attention that my likeness and the likeness of the
rest of Freedom Phalanx is being used on your Paragon City
Touristry Board website. It appears their use is to promote
your
website. Make no mistake, the Freedom Phalanx
does not sponsor your conspiracy theorist website and has no desire to
be
associated with your libelous and fallacious claims.
If these images are not taken down soon, I will soon contact my
lawyer
and he will take you to court soon.
Your website is an insult
to the fine heroes I currently fight alongside, as well as the ones
that have long since perished. While I cannot prevent you
from spreading your lies, I will not stand for my image being used in
this manner. This is trademark infringement. Please
comply soon
or you will be hearing from my lawyer soon. Soon.

I contacted my own lawyer about the above letter. Many
citizens of Paragon City have likely seen billboards of Chris Jenkins
around Paragon City. He’s a high profile attorney
that, like me, is attempting to put the heroes in this city in line and
hold them accountable about their actions. Here’s
what he had to say:

Fletcher: Does Statesman have a
case against me? Am I breaking a trademark by having his
image on my website?
Chris
Jenkins: Certainly not. Now, if you were to have pieces of
his costume
scattered across the site which could loosely resemble
Statesman’s
costume when combined, he would. Obviously that is not the
case.
Anyone who thinks you can sue based on the complete image and name is
off their rocker. It has to be tiny, inconsequential pieces
of his
costume and image. Then he’d have a valid
complaint. Perhaps Statesman needs
to go back to law school before threatening anyone like this! |
